1. 條款接受
歡迎使用 Noba(以下簡稱「本服務」或「App」)。當您下載、安裝、註冊或使用本 App 時,即表示您已閱讀、理解並同意遵守本服務條款(以下簡稱「本條款」)。若您不同意,請勿使用本服務。
若您未滿 18 歲,須由法定監護人閱讀並同意本條款後始得使用。未滿 13 歲者,請參閱《隱私政策》中的兒童資料條款。
2. 服務描述
Noba 是一款行動裝置語言學習應用程式,提供以下功能:
- AI 情境對話:透過 Google Gemini 大型語言模型進行語言對話練習。
- 發音評分:透過語音輸入與 AI 模型(Gemini 或 OpenAI Whisper)提供發音準確度回饋。
- 間隔重複系統(SRS):基於 SM-2 演算法的單字與語句複習機制。
- 沉浸式課程:多題型題庫(配對、填空、造句、聽力、打字、情境對話等)。
- 熟練度追蹤:課程完成度、XP、連續天數、發音弱點診斷等學習分析。
本服務支援多種語言學習(包含英語、日語、韓語等,實際語言清單以 App 內顯示為準,持續擴充)。
免費版含 Google AdMob 廣告;付費訂閱(Tier B/C/D)後無廣告。
3. 帳號與註冊
- 您須以有效電子郵件註冊帳號,並妥善保管登入憑證。
- 帳號僅供個人使用,不得轉讓、出租或分享。
- 您須對以您帳號進行的所有活動負責。
4. 訂閱與付費
本服務採免費增值(freemium)模式,部分進階功能須訂閱付費方案方可使用。
4.1 訂閱方案(tier)
目前提供以下付費層級(實際價格與方案以 App 內當時顯示為準):
- Tier B(基礎 Pro):開通完整 SRS、進階題型等。
- Tier C(進階 Pro):包含 Tier B 全部功能 + AI 情境對話提升額度 + 發音診斷進階報告。
- Tier D(最高 Pro):包含 Tier C 全部功能 + 個人化 AI 家教 + 16 週學習預測 + 不限使用量。
為清楚識別,App 內介面顯示為 Pro / Plus / Premium,與本條款 B/C/D 對應一致。
每個 tier 均提供月費與年費方案。
4.2 試用期
- 部分方案提供 7 天或 14 天免費試用(以 App 內提示為準)。
- 試用期結束前若未主動取消,將自動轉為正式訂閱並依您選擇的週期扣款。
- 您可於試用期內隨時於 Google Play 訂閱管理中取消,避免任何費用產生。
4.3 支付方式
- 所有付費交易均透過 Google Play Billing 完成,本服務不直接向您收取款項。
- 續訂、取消、付款爭議等事項,均受 Google Play 政策規範。
4.4 退款政策
- 退款申請請逕向 Google Play 提出,流程與條件依 Google Play 退款政策 執行。
- 本服務不直接受理退款,但在 Google 核可後會停止相應服務。
- 依《通訊交易解除權合理例外情事適用準則》第 2 條第 5 款,本服務屬「非以有形媒介提供之數位內容或一經提供即為完成之線上服務」,經您於下載或啟用前同意本條款,即免除七日鑑賞期;退款一律依 Google Play 政策辦理。
4.5 自動續訂
- 訂閱會自動續訂,除非您於當期結束前至少 24 小時於 Google Play 取消。
- 續訂費用將於當期結束前 24 小時內自動從您的 Google Play 帳戶扣款。
5. 使用者義務與禁止行為
使用本服務時,您同意:
- 不得濫用 AI 對話功能:禁止利用 AI 模型產生違法、仇恨、騷擾、色情、暴力、詐騙或侵權內容。
- 不得逆向工程:禁止反組譯、反編譯、拆解本 App、嘗試取得原始碼、API key 或繞過付費機制。
- 不得自動化濫用:禁止使用機器人、腳本、爬蟲批量請求 AI 服務,以規避使用量限制。
- 不得冒用他人身分:不得註冊虛假帳號或冒充他人。
- 不得散布惡意內容:不得上傳病毒、惡意程式、或試圖破壞本服務運作。
違反者,本服務得依情節暫停或終止您的帳號,並保留法律追訴權。
6. AI 生成內容免責聲明
本服務之 AI 對話、AI 翻譯、AI 評分均由第三方大型語言模型(如 Google Gemini、OpenAI Whisper)產生。
- AI 回覆僅供學習參考,不保證 100% 語言正確性、事實準確性或文化適當性。
- 發音評分為 AI 近似判斷,分數僅供學習進度追蹤,不得作為語言能力正式檢定依據。
- 您不應將 AI 回覆用於醫療、法律、金融、學術論文等需要專業準確性的場合。
- 使用 AI 生成內容所產生之任何後果,由使用者自行承擔。
7. 智慧財產權
- 本服務之軟體、介面、商標、Logo、課程結構、原創文字、圖片等,均為本服務營運者所有或已取得合法授權。
- 使用者學習歷程記錄(XP、SRS 狀態、錯誤記錄等)屬於使用者個人資料,您擁有存取與刪除權利,詳見《隱私政策》。
- AI 生成之對話內容,其權利歸屬依各 AI 模型供應商(Google、OpenAI)之條款為準。
8. 帳號終止
8.1 使用者主動終止
您可隨時於 App 設定頁刪除帳號。帳號刪除後,您的學習資料將於 30 天內永久清除(詳見《隱私政策》)。
8.2 本服務終止
若您有以下情形之一,本服務得立即暫停或終止您的帳號:
- 違反本條款第 5 條任一禁止行為
- 重大違反適用法律
- 從事詐欺、濫用付費機制(如信用卡盜刷爭議)
- 連續 24 個月未登入(系統清理不活躍帳號)
終止後,未使用之訂閱期間退款請洽 Google Play。
9. 責任限制
在適用法律允許之最大範圍內:
- 本服務按「現狀」(as-is)提供,不對可用性、無錯誤性、特定用途適合性作擔保。
- 本服務不對您因使用本 App 所產生之間接、附隨、衍生性損失負責(包含但不限於學習成效未達預期、資料遺失、設備損壞)。
- 本服務之總賠償責任上限,不超過您於爭議事件發生前 12 個月內實際支付予本服務之訂閱費用總額。
上述限制不影響消費者依台灣《消費者保護法》等強制性法律所享之權利。
10. 條款修改
- 本服務得隨時修訂本條款。
- 重大變更(如訂閱方案重大調整、責任範圍縮減)將於生效前至少 30 天以 App 內公告、Email 或其他合理方式通知您。
- 若您不同意修訂後條款,得於生效前終止帳號。
- 在條款修訂生效日後繼續使用本服務,視為接受修訂後條款。
11. 準據法與爭議解決
- 本條款之解釋與適用,以中華民國(台灣)法律為準據法。
- 因本條款所生之爭議,雙方同意以台灣臺北地方法院為第一審管轄法院,但不影響消費者依《消費者保護法》得選擇其他管轄法院之權利。
- 若您為歐盟、英國、瑞士或 EEA 成員國之消費者,您仍得依其所在國強制性消費者保護法律主張權利,不受第 11 條準據法限制。

12. 可分離性
本條款任一條款若經法院判定無效或無法執行,不影響其他條款之效力。

1. Acceptance of Terms
Welcome to Noba (the "Service" or "App"). By downloading, installing, registering, or using this App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (the "Terms"). If you do not agree, please do not use the Service.
If you are under 18 years old, you must have a legal guardian read and consent to these Terms on your behalf before use. For users under 13, please refer to the children's data provisions in our Privacy Policy.
2. Description of Service
Noba is a mobile language-learning application that provides:
- AI Scenario Conversations: Language practice powered by Google Gemini large language models.
- Pronunciation Scoring: Speech-input pronunciation feedback via AI (Gemini or OpenAI Whisper).
- Spaced Repetition System (SRS): Vocabulary and sentence review based on the SM-2 algorithm.
- Immersive Courses: Multiple exercise types including matching, cloze, sentence building, listening, typing, and scenario chat.
- Mastery Tracking: Lesson completion, XP, streak, pronunciation weakness diagnostics.
The Service supports multiple languages (including English, Japanese, Korean, etc. — see in-app list for the current set; more languages may be added over time).
The free tier displays Google AdMob ads; paid subscriptions (Tier B/C/D) are ad-free.
3. Account and Registration
- You must register with a valid email address and keep your credentials secure.
- Accounts are for personal use only and may not be transferred, rented, or shared.
- You are responsible for all activity under your account.
4. Subscriptions and Payment
The Service uses a freemium model. Certain advanced features require a paid subscription.
4.1 Subscription Tiers
- Tier B (Basic Pro): Full SRS, advanced exercise types.
- Tier C (Advanced Pro): All Tier B features + increased AI chat quota + advanced pronunciation diagnostics.
- Tier D (Premium Pro): All Tier C features + personalized AI tutor + 16-week mastery projection + unlimited usage.
For clarity, the in-app interface displays these tiers as Pro / Plus / Premium, corresponding consistently to B/C/D in these Terms.
Each tier is offered in monthly and annual plans. Current prices are shown in-app at the time of purchase.
4.2 Free Trials
- Some plans offer a 7- or 14-day free trial (as indicated in-app).
- If you do not cancel before the trial ends, the subscription will automatically convert to a paid plan and be billed according to your chosen cycle.
- You may cancel at any time during the trial via Google Play subscription management to avoid charges.
4.3 Payment Method
- All transactions are processed via Google Play Billing. We do not bill you directly.
- Renewals, cancellations, and billing disputes are governed by Google Play policies.
4.4 Refund Policy
- Refund requests must be made directly to Google Play per Google Play refund policy.
- We do not process refunds directly but will terminate service access upon Google-approved refunds.
- Under Article 2, Paragraph 5 of Taiwan's Regulations on Reasonable Exceptions to the Consumer's Right of Withdrawal in Distance Transactions, the Service qualifies as "digital content not supplied on a tangible medium, or an online service that is completed upon provision". By agreeing to these Terms prior to download or activation, you waive the 7-day cooling-off period; refunds are handled exclusively per Google Play policy.
4.5 Auto-Renewal
- Subscriptions auto-renew unless canceled at least 24 hours before the current period ends.
- Renewal charges will be processed within 24 hours before the current period ends via your Google Play account.
5. User Obligations and Prohibited Conduct
You agree NOT to:
- Abuse AI features: Use the AI models to produce illegal, hateful, harassing, sexual, violent, fraudulent, or infringing content.
- Reverse engineer: Decompile, disassemble, or attempt to access source code, API keys, or bypass paid features.
- Automate abuse: Use bots, scripts, or crawlers to bulk-query AI services or circumvent usage limits.
- Impersonate others: Create fake accounts or misrepresent your identity.
- Spread malicious content: Upload viruses, malware, or attempt to disrupt the Service.
Violations may result in suspension or termination of your account, and we reserve the right to pursue legal remedies.
6. AI-Generated Content Disclaimer
AI chat, translation, and scoring are provided by third-party large language models (Google Gemini, OpenAI Whisper).
- AI responses are for learning reference only and do not guarantee 100% linguistic, factual, or cultural accuracy.
- Pronunciation scores are AI approximations and should not be used as formal language proficiency certification.
- Do not rely on AI output for medical, legal, financial, academic, or other domains requiring professional accuracy.
- You bear all consequences of your use of AI-generated content.
7. Intellectual Property
- The Service's software, interface, trademarks, logos, lesson structures, original text, and images are owned or licensed by the Service operator.
- Your learning records (XP, SRS state, error logs) are your personal data; you have access and deletion rights per the Privacy Policy.
- Rights to AI-generated conversation content are governed by the respective AI providers' (Google, OpenAI) terms.
8. Account Termination
8.1 By You
You may delete your account at any time in the in-app settings. Upon deletion, your learning data will be permanently erased within 30 days (see Privacy Policy).
8.2 By Us
We may suspend or terminate your account if you:
- Violate any prohibition in Section 5.
- Materially violate applicable law.
- Engage in fraud or chargeback abuse.
- Remain inactive for 24 consecutive months (cleanup of dormant accounts).
Refunds for unused subscription periods must be requested via Google Play.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as-is" without warranties of availability, error-free operation, or fitness for a particular purpose.
- We are not liable for indirect, incidental, or consequential damages (including unmet learning outcomes, data loss, device damage).
- Our total liability shall not exceed the subscription fees you paid in the 12 months preceding the dispute.
These limitations do not affect consumer rights under mandatory applicable law.
10. Changes to Terms
- We may revise these Terms at any time.
- Material changes (e.g., significant subscription changes, liability reductions) will be announced at least 30 days in advance via in-app notice, email, or other reasonable means.
- If you disagree, you may terminate your account before the effective date.
- Continued use after the effective date constitutes acceptance.
11. Governing Law and Dispute Resolution
- These Terms are governed by the laws of the Republic of China (Taiwan).
- Disputes shall be submitted to the Taipei District Court, Taiwan, as the court of first instance, without prejudice to consumer rights to other forums under Taiwan's Consumer Protection Act.
- If you are a consumer in the EU, UK, Switzerland, or an EEA member state, you retain the right to invoke mandatory consumer protection laws of your country of residence, notwithstanding the choice of law in Section 11.

12. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in effect.
